  5. We at Cygnus Productions appreciate the efforts of vendors and BBS
  6. systems for their contribution to the shareware market and the
  7. industry.  If you have any questions or comments about the following
  8. terms or WinFile BackUp, please feel free to contact us at the address

  11. This file contains acceptable descriptions for catalogs, libraries or
  12. BBS use, requirements for distributors, and additional information.

  15. PC SYSTEM REQUIREMENTS
  16. ----------------------------------------------------------------------

  18.    Hardware: Any PC that is able to run Microsoft Windows 3.0.
  19. Recommended: 386 class microprocessor or better with 4Mb RAM.

  21. Software: Microsoft Windows 3.0 or better.

  24. DISTRIBUTION TERMS FOR WINFILE BACKUP

  27. Disk vendors, other software librarians or distributors who wish to
  28. distribute WinFile BackUp may contact us at the address below for
  29. information on any special licensing terms or considerations (i.e.
  30. royalties). The permission of the copyright holder, Cygnus Productions,
  31. must be attained BEFORE ANY distribution occurs.  WinFile BackUp v3.00
  32. may NOT be distributed without prior consent to do so unless automatic
  33. permission is granted by meeting one of the conditions below that allow
  34. for automatic permission to distribute.

  36. Those who wish to distribute WinFile BackUp v3.00 to others, whether
  37. for free or in return for money or other considerations, regardless of
  38. what type of media or through what medium you choose to distribute it
  39. through, must adhere to the requirements below.

  41. Please review all of the following terms, notices, and disclaimers:

  43. 1) Permission to distribute is automatically granted to catalog
  44.    vendors provided the following conditions are met:

  46.      a) The catalog must contain a statement to the effect that the
  47.         software is not free and that a registration fee applies if
  48.     the buyer decides to use the software obtained from your
  49.     catalog.

  51.      b) Updated versions of the software sent to the distributor will
  52.         be reflected in what is distributed and advertised in their
  53.         catalog or listing as soon as possible.

  55.      c) A copy of the first catalog advertising the distribution of
  56.         the software will be sent to Cygnus Productions for our
  57.         records. (See below for the address.)

  59. 2) All BBS systems and electronic information systems (i.e.,
  60.    CompuServe, America Online, etc.) are automatically
  61.    granted permission to distribute WinFile BackUp v3.00.
  62.  
  63. 3) "Rack" distribution or any other type of distribution in a retail
  64.    environment requires written permission, must adhere to the
  65.    distribution term 1a above insofar as packaging and advertisement
  66.    is concerned, and may be subject to special licensing terms or
  67.    other considerations (i.e., royalties).  Contact Cygnus
  68.    Productions for more information on this type of distribution.

  70. 4) Distribution via CD-ROM requires written permission, must adhere
  71.    to the distribution term 1a above insofar as packaging and
  72.    advertisement is concerned, and may be subject to special
  73.    licensing terms or other considerations (i.e., royalties). Contact
  74.    Cygnus Productions for more information on this type of
  75.    distribution.

  77. 5) No renewal of this permission is necessary.  However, all
  78.    distributors should be aware that permission to distribute
  79.    (whether it be granted automatically or through special written
  80.    permission) can be withdrawn from any distributor, at any time,
  81.    for any reason, at the sole discretion of the copyright holder,
  82.    Cygnus Productions, on reasonable advance notice (at least 30
  83.    days).

  85. 6) THE SOFTWARE IS PROVIDED "AS-IS." NO WARRANTIES OF ANY KIND,
  86.    EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.
  87.    WE WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE
  88.    OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM
  89.    NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT,
  90.    EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
